ORDER

This Writ Petition has been filed to call for the records relating to the allotment dated 1.11.1991 and quash the allotment of plot No.295 made to the 5th respondent Noorul Gazali issued by the 2nd respondent and consequently direct the respondents to allot the passage to their to ingress and egress from

their respective Plot No.291 and Plot No.292 and to direct the 2nd respondent to execute the Sale deed in favour of the petitioners in respect of plot No.291 and Plot No.292, 4th cross street, Indira Nagar, Virugambakkam, Chennai.

2. When the Writ Petition is taken up for hearing, the learned counsel appearing for the petitioner seeks permission of this Court to withdraw the petition and has made an endorsement to that effect.

3. In view of the submission and the endorsement made by the learned counsel appearing for the petitioner, this Writ Petition is hereby dismissed as withdrawn. Further, taking note of the fact that the dispute relates to a pathway, liberty is granted to the petitioner to approach the Civil Court for appropriate orders. Consequently, connected miscellaneous petitions are closed. No costs.
