Respondents Prayer:- Criminal Original Petition filed under Section 482 Cr.P.C., to direct the Inspector of Police, Thally, Krishnagiri, the 1st respondent herein to register a case based on the petitioner's complaint dated 09.06.2016 FIR under Sections 379,447, 426 and 506(ii) IPC, against (1) Prakash Reddy and (2) Nagabushanam, both sons of Late Ramachandra Reddi, residing at Errakondapalayam Village, Devnanapalli Post, Denkanikottai Taluk, Krishnagiri District and (3) Krishna Reddi, Son of Munusamy reddi, Krishnagiri Taluk and District and consequently take action against the above said persons in accordance with law to protect the life and property of the petitioner.

This petition has been filed to direct the Inspector of Police, Thally, Krishnagiri, the 1st respondent herein to register a case based on the petitioner's complaint dated 09.06.2016 FIR under Sections 379,447, 426 and 506(ii) IPC, against (1) Prakash Reddy and (2) Nagabushanam, both sons of Late Ramachandra Reddi, residing at Errakondapalayam Village, Devnanapalli Post, Denkanikottai Taluk, Krishnagiri District and (3) Krishna Reddi, Son of Munusamy reddi, Krishnagiri Taluk and District and consequently take action against the above said persons in accordance with law to protect the life and property of the petitioner.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.

3. It is represented by the learned Additional Public Prosecutor that based on the petitioner's complaint dated 09.06.2016, the petition enquiry is pending in C.S.R.No.112/2016, before the first respondent. 4.

Recording the submission of the learned Additional Public Prosecutor, the first respondent is directed to conduct enquiry and during the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, in accordance with the law laid down by the Honourable Apex Court in Lalita Kumari vs. Govt. of U.P. & others [(2014) 4 SCC 1], otherwise, the petition may be closed under intimation to the petitioner.

This Criminal Original Petition is disposed of with the above direction.
