A.Nos.1476 and 1477 of 2024 in C.S. (Comm. Div.) No.684 of 2019 ABDUL QUDDHOSE.J., The defendants have filed the aforementioned applications seeking for the following reliefs:

a) Seeking leave of this Court to withdraw the counter claim; b) Allow the refund of the Court fees paid by the defendants for the counter claim.

2. The suit filed by the plaintiffs has already been dismissed as withdrawn by this Court's order dated 11.09.2023. A counter claim was made in the said suit. The defendants now seek withdrawal of the counter claim as well and also seek refund of the Court fees paid for the counter claim amount. Learned counsel for the plaintiffs has stated no objection for allowing these applications.

ABDUL QUDDHOSE.J., ab Accordingly, both the applications are allowed as prayed for and the counter claim filed by the defendants is dismissed as withdrawn and the Registry is directed to refund the Court fees paid by the defendants for the counter claim amount.
