Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondents to grant second set of incentive increment to the petitioner for P.G. Diploma in Engineering from May 2019 by bifurcating and classifying P.G. Diploma in Engineering subject with P.G. Degree in Engineering under Schedule No. IV of said G.O.(Ms).No.240 School Education (V.E) dt 18.08.2010 in consonance with Para 4 of said G.O.

Heard Mr.R.Saseetharan, learned counsel for the petitioner and Mr.P.Gurunathan, learned Additional Government Pleader for the respondents 1 to 4 and perused the materials available on record. 2.
The petitioner has been appointed as Vocational Instructor on 08.02.1989 at Government Higher Secondary School, Metur Dam, Salem District and she acquired P.G. Diploma in Engineering. The petitioner claims that as per G.O.(Ms).No.240, School Education (V.E), dated 18.08.2010, U.G. Degree and U.G. Diploma are one set and further qualification like P.G. Degree and P.G. Diploma are another set. According 2/5
to the petitioner, she has qualified U.G. degree and thereafter, she has acquired P.G. Diploma and hence, she is eligible to get 2 incentive increments. In this regard, the petitioner has given representation dated 21.12.2020 to the 1st respondent but so far the said representation has not been considered. Aggrieved over the same, the petitioner has filed this Writ Petition.

It is not in dispute that G.O.(Ms).No.240, School Education (V.E), dated 18.08.2010 has been issued with regard to the incentive increments for higher qualification but it is for the 1st respondent to consider the representation of the petitioner dated 21.12.2020 in the light of the above Government Order or any other future developments that might have taken place by issuance of subsequent Government Orders and pass appropriate orders, within a period of four (4) weeks from the date of receipt of a copy of this order.
