ORDER
This writ petition has been filed for the issue of writ of mandamus directing the 1 st respondent to deal with the application submitted by the petitioner on 23.08.2024 wherein the petitioner is seeking for the survey, subdivision and issuance of separate patta in his favour. 2.
Heard Mr.P.Sarveswaran, learned counsel for the petitioner and Mr.A.Selvendran, learned Special Government Pleader for respondents 1 and 2. 3.
The petitioner is relying upon the sale deed dated 09.09.1996 and the judgement and decree in OS No.408 of 2015 dated 28.06.2023. The application was submitted on 23.08.2024 and since the same did not evoke any response, the present writ petition has been filed before this Court. 4.
Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the 1 st respondent to act upon the application submitted by the petitioner on 23.08.2024 on its own merits and in accordance with law and the survey shall
be conducted within a period of four weeks form the date of receipt of a copy of this order. Thereafter, the sub division and issuance of separate patta shall be followed up and appropriate orders shall be passed within a period of six weeks thereafter. If there are any rival claimants, they shall be put on notice. 5.
This writ petition is disposed of with the above directions. No costs.
