O R D E R
This Revision has been preferred as against the order passed in Crl.M.P.No.2759 of 2023 in C.C.No.1335 of 2019 dated 10.10.2024 on the file of the learned VIII Metropolitan Magistrate, George Town, Chennai thereby allowed the petition filed under Section 302 of Cr.P.C.,
2. Heard the learned counsel for the petitioner and perused the documents placed on record.
3. The respondent filed a complaint for offence under Section 138 of Negotiable Instruments Act as against the petitioner and the same has been taken cognizance by the trial court. While pending trial, the complainant died and as such, one of the legal heirs, who is none other than the daughter of the complainant, filed a petition to substitute her as a complainant instead of deceased complainant and she had also filed no objection from another daughter of the complainant. The trial court rightly allowed the petition and this Court finds no infirmity in the said order.
Accordingly, the present Revision is dismissed and the order passed by the learned VIII Metropolitan Magistrate, George Town,
Chennai in Crl.M.P.No.2759 of 2023 dated 10.10.2024 is confirmed. Consequently, connected miscellaneous petition is closed. 14.08.2025 Index : Yes/No : Yes/No Speaking/non-speaking order ssd To The VIII Metrpolitan Magistrate, George Town, Chennai.
