IN THE HIGH COURT OF JUDICATURE AT MADRAS

DATED: 25.04.2022

CORAM

THE HONOURABLE Ms. JUSTICE P.T. ASHA Mani ... Petitioner Vs 1.Ravichandran 2.Savithiri ... Respondents Prayer: The petition is filed under Order XLVII Rule 1 r/w Section 114 of CPC against the order dated 16.02.2022 passed in C.R.P.(PD).No.2905 of 2021.

For Petitioner :

Mr.K.Govi Ganesan 1/4

ORDER

The above matter is posted for reviewing the order dated 16.02.2022, since the sale deed dated 31.08.2005 would show that the entire suit property was sold to the 1st respondent therein therefore the observation at paragraph no.11 was causing a bit confusion in the mind of the Presiding Officer.

2. I am at loss to understand as to how there can be any confusion considering the fact that what has been mentioned in the said paragraph is that the review petitioner would be entitled only to the portion of the property which fell to the share of the father.

3. In the light of the above, I do not see any necessity to review the order. However, the learned counsel would submit that it may be 2/4

elaborated that what has been been stated is that the Sub Judge, Mettupalayam should allot the share of the deceased 1st defendant, namely, 1/4th share of the father in the property. The review petition is therefore dismissed with the above elaboration. No costs. 25.04.2022 kan Index: Yes/No Speaking order/non-speaking order 3/4
