PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus, calling for the records relating to Advertisement No.02/2021 dated 26.02.2021 issued by the 1st respondent calling for applications for direct recruitment for the post of Special Teachers in Physical Education in School Education and other Departments for the year 2020-2021 and quash the same in so far as Clause 4 dealing with qualification for the post of Special Teachers in Physical Education has been fixed as 45 years of age for Backward Class, Most Backward Class and Scheduled Caste candidates for applying for direct recruitment to the post of Special Teachers in Physical Education coming under the Tamil Nadu School Eduational Subordinate Service for the year 2020-2021 as 57 years of age under Advertisement No.02/2021 dated 26.02.2021 issued by the 1st respondent as stipulated in Notification No.05.2017 dated 26.07.2017.

This writ petition has been filed challenging the Advertisement No.2/2021 dated 26.02.2021 issued by the 1st respondent calling for applications for direct recruitment for the post of Special Teachers in Physical Education in School Education Department and other departments for the year 2020-2021 insofar as Clause 4 dealing with qualification has been fixed as 45 years of age for Backward Class, Most Backward Class and Scheduled Caste candidates is concerned and seeking consequential direction to fix the age at 57 years and to continue the recruitment process.
2. Pursuant to the interim directions passed by this Court, all the petitioners have submitted their applications. However, further recruitment process has not been concluded as on date.
3. Today, when the matter is taken up for hearing, it is brought to the notice of this Court that subsequently, the Government has issued G.O.Ms.No.185 dated 21.10.2023 fixing the age at 58 years. 3/6

Therefore, practically the relief sought by the petitioners herein is granted by the Government itself and in view of the fact that the age limit is fixed at 58 years as against the relief sought by the petitioners to fix the same as 57 years, the main relief sought in the writ petition has become infructuous. However, on the date of Advertisement, the said G.O.Ms.No.185 dated 21.10.2023 was not issued. But, considering the fact that the recruitment has not been concluded so far and the petitioners have already submitted their applications, in case the 1st respondent intends to proceed further with the recruitment process, the applications already submitted by the petitioners shall be considered by duly taking into consideration the orders issued by the Government vide G.O.Ms.No.185 dated 21.10.2023.
5. In the light of the above, the writ petition is disposed of. No costs. Consequently, the connected miscellaneous petitions are closed. 23.07.2024 Index : Yes/No : Yes/No nr 4/6
