Criminal Original Petition filed under Section 482 of Cr.P.C. praying to issue direction to the respondent to register FIR against the accused persons namely Rajamanohar, the Executive Director of the BHEL company and other persons based on the complaint dated 04.01.2018, and investigate in accordance with law and under Court monitored investigation. ORDER

This petition is filed seeking direction to CBI to register the complaint sent by the petitioner herein on 04.01.2018, alleging violation of Tender Policy in BHEL, more particularly, alleging that the successful bidder namely M/s. Seam Industries has criminal antecedents and Integrity Pact has not complied by the successful bidder.

The entire reading of the alleged complaint does not provide any material to show that the successful bidder viz. M/s. Seam Industry face trial for money laundering. Without furnishing materials, a bald allegations is made against the successful bidder and the Director of BHEL and the same cannot be the basis for setting the criminal law into motion and to direct the CBI to investigate the matter.

Hence, this Court finds no materials in this application. Accordingly, this Criminal Original Petition stands dismissed. It is open to the petitioner to seek appropriate remedy if adequate materials are available with him. If materials sufficient to take cognizance is produced to the authorities concerned, no doubt they will take appropriate action.
