ORDER

This Criminal Original Petition is filed to modify the condition to deposit the original title deed standing in the name of the petitioner's father before the concerned court till the disposal of the case in Crime No.159 of 2017 on the file of the respondent police in Crl.M.P.No.982 of 2017, on the file of Principal Sessions Judge, Krishnagiri. 2.The petitioner is aggrieved against the onerous condition imposed in Crl.M.P.No.982 of 2017, on the file of Principal Sessions Judge, Krishnagiri, directing the petitioner to deposit the original title deed, while granting bail.

3.This Court, in identical situations had already expressed its anguish on such orders being pronounced imposing onerous condition of depositing the original title deeds. https://hcservices.ecourts.gov.in/hcservices/

There is no provision of Law, which indicates production of original title deeds as a pre-condition of granting bail. 4.In view of the same, the Criminal Original Petition stands allowed. The order dated 24.07.2017 passed in Crl.M.P.No.982 of 2017 in Crime No.159 of 2017, on the file of the learned Judicial Magistrate-II, Hosur, is modified to the effect that the petitioner shall be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate-II, Hosur and further the petitioner shall appear before the respondent/Police concerned daily at 10.00 a.m., until further orders of the learned Judicial Magistrate-II, Hosur.
