PRAYER: Second Appeal filed under Section 100 of C.P.C., to set aside the Judgment and Decree dated 19.10.2012 in A.S.No.61 of 2011 on the file of the Subordinate Judge, Vellore partly allowing the Judgment and Decree dated 25.07.2011 in O.S.No.393 of 1997 on the file of the Principal District Munsif, Vellore.

JUDGMENT

When the matter was taken up for hearing on 15.03.2022, the learned counsel for the appellant submitted that he has no instructions from the appellant and sought for some time to send a formal letter to the appellant through Registered Post. Pursuant to the same, the learned counsel for the appellant has sent a letter dated 14.03.2022 to the first appellant, who is the wife of the original plaintiff P.M.Palani. The learned counsel submitted that till now no instructions have been received from the appellants and hence he is reporting no instructions.

2. Taking into consideration the letter sent by the learned counsel for the appellant to the appellants informing them that he will report no instructions if he does not get any information from the appellant, this second appeal is closed. Consequently connected miscellaneous petition is also closed. There will be no order as to costs.
