Petitions filed under Article 226 of the Constitution of India praying for issue of Writ of Mandamus (i) WP.14801/2015 - to direct the 1st respondent tor e-fix the seniority based on the G.O. (Ms.) No.93 Home (Police-3) Department dated 06.02.2015 within a reasonable time and (ii) WP.14802/2015 - to direct the 1st respondent to re-fix the seniority based on the G.O. (Ms.) No.93 Home (Police-3) Department dated 06.02.2015 by considering the petitioner representation dated 20.04.2015 within a reasonable time.

By consent, the writ petitions are taken up for final disposal.

2.The writ petitions are filed by the petitioners seeking Writ of Mandamus to direct the respondents to consider their case for re-fixation of seniority based on G.O. (Ms.) No.93, dated 06.02.2015.

3.The petitioners are the directly recruited Sub-Inpectors of Police, recruited in the year 1997-1998 and they belong to Most Backward Class Community. The grievance of the petitioners is that though they have secured higher marks in the recruitment selection process, they were sent for training only in the second batch on 22.05.2000, resulting anomaly in the fixation of seniority. It is their case that in identical cases, orders have been passed to consider the representation of similarly placed persons with that of the petitioners and to pass suitable orders in accordance with law.

4.Hence, following the same, this Court directs that the representations of the petitioners dated 20.03.2015 and 20.04.2015 respectively be disposed of by the authority concerned on merits and in accordance with law, in the light of the orders passed by this Court in W.P.No.1699 of 2012, on which basis G.O. (Ms.) No.93, Home (Police-3) Department, dated 06.02.2015 has been issued. The said exercise shall be carried out within a period of six (6) weeks from the date of receipt of copy of this order. 5.With the above direction, the writ petitions are disposed of. No costs.
