ORDER
This Writ Petition has been filed seeking issuance of writ of mandamus, directing the respondents 1 to 4 not to give any approval for the residential plots in Venkateshwara Nagar for any commercial purpose and also direct the 2nd respondent to remove and vacate the shops at Venkateshwara Nagar, Agarmel which is running by the 5th and 6th respondents without any permission from the authorities.
2. The learned counsel appearing for the petitioner referred the order of the 1st respondent dated 29.01.2022 wherein, it has been stated that no permission will be given for the purpose of establishing commercial activities without any prior approval however, without complying the said order and
without getting any prior approval, the 5th & 6th respondents constructed commercial shops and they have been running the same. Therefore, the petitioner Association sent a notice dated 03.01.2022 & 05.02.2022 to the 5th & 6th respondents respectively. Since the same has not evoked any response, the present writ petition is filed.
3. The learned counsel appearing for the Official respondents would submit that they would follow the directions issued by the 1st respondent vide order dated 29.01.2022 and take appropriate action.
4. In view of the submissions made, the 2nd respondent is directed to strictly comply the order passed by the 1st respondent dated 29.01.2022 before granting any approval for commercial establishments in the subject properties. In the event if any person is making commercial establishments without getting prior approval, the respondent concerned shall take necessary action against those persons, by following the due procedure of law.
