To call for the records connected with the impugned order vide proceedings No. Lr.No. WP 42107 of 2025/ CGM/ LAND/ 2026 dated 16.02.2026 issued by the 1st respondent and quash the same and further direct the 1st respondent to recognise and regularise the petitioners occupation in the rehabilitation/ resettlement area by allotting a residential plot in favour of the petitioner being the legal heir of the deceased Amulraj the original land loser, as granted to similarly situated persons who were allotted residential sites within the time frame as may be fixed by this Honble court and to pass For Petitioner(s):

The eviction order directing the petitioner to vacate the land belong to NLC India Limited, vide proceedings dated 16.02.2026, is under challenge in the present writ proceedings.

2. Learned counsel for the petitioner would submit that the lands belonged to the father of the petitioner was acquired and the respondents made an assurance that they will provide an employment under the land loser's category. That apart, the petitioner state that the then Chief Engineer orally permitted the petitioner to occupy the said land and thus, the petitioner need not be construed as an encroacher.

3. Learned counsel for the respondents would oppose by stating that vast extent of lands were acquired by the Government and handed over to NLC. NLC had taken over the land. Ssince the petitioner has been identified as an encroacher, show cause notice issued and thereafter, an eviction notice dated 28.06.2024 was issued to the petitioner. All otherencroachers were evicted from the land except the petitioner. Thus, the NLC/respondent have issued multiple eviction notice to the petitioner to vacate the encroached portion enabling them to continue their activities. Despite, the eviction notice issues on several occasion, the petitioner failed to vacate the land belongs to the NLC and thus, final eviction notice came to be issued.

4. The petitioner earlier filed W.P.No.42107 of 2025 and this Court passed an order on 02.12.2025 directing the respondents to take a final decision for removal of encroachment . Now, a final decision has been taken in pursuance to the order of this Court and an eviction order came to be passed.

5. Since the petitioner has not made out even a semblance of legal rights, this Court is not inclined to entertain the writ petition. Accordingly, the writ Petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
