The Civil Revision Petition is filed under Article 227 of the Constitution of India to direct the III Additional Judge, City Civil Court, Chennai to pass orders in IA.No.2742 of 2016 in OS.No.14303 of 2010 within a specified dated. For petitioner : Mr.G.A.Thiyagarajan ORDER:
According to the petitioner, the petitioner has filed an
application in IA.No.12083 of 2016 to condone the delay in filing an application to set aside the ex-parte order passed in OS.No.14303 of 2010, was allowed by the court below. Thereafter, the petitioner has filed an application in IA.No.2742 of 2016 under Order 9 Rule 13 of the Civil Procedure Code, which is still pending. Therefore, the revision petitioner has filed the present Civil Revision Petition before this Court for the aforesaid prayer.
2. By considering the nature of the relief as prayed for in the present Civil Revision Petition, without expressing any opinion on merits, this Court is inclined to direct the trial court to dispose of the application in IA.No.2742 of 2016 in OS.No.14303 of 2010 as expeditiously as possible, preferably within four weeks from the date of receipt of a copy of this Order.
3. The Civil Revision Petition is disposed of with above direction. No costs.
