Petition filed under Section 11 of the Contempt of Courts Act, 1971 (Central Act 70 of 1971) praying to punish the Respondent herein for willfully disobeying the order of this Court dated 31.07.2014 passed in Crl.O.P.No.19959 of 2014.

O R D E R

The learned counsel for the petitioner, the learned Government Advocate (Crl.Side) and the contemnor are present.

2.The contemnor has filed an affidavit placing unconditional apology for his non-appearance before this Court. The learned Government Advocate (Crl.Side) has also submitted the circumstances under which the contemnor was not able to appear in the morning session when the matter was called.

3.Though this Court is not inclined to condone the conduct on the part of the contemnor, this Court, having regard to the submission made by the learned Government Advocate (Crl.Side) and considering the further action taken in re-opening the enquiry and in holding a fresh enquiry and in registering FIR in Crime No.635 of 2015 dated 11.06.2015 for offence under Section 420 of IPC, feels that no further order is necessary in this contempt petition and the Contempt Petition is hence closed. Further direction is issued to the Investigating Officer to conduct a proper investigation and file the final report as expeditiously as possible. No costs.
