ORDER

The petitioner, who was arrested and remanded to judicial custody on 20.01.2026 for the alleged offences under Sections 309(5) of B.N.S. in Crime

No.20 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused unlawfully assembled with deadly weapons in order to commit dacoity. Hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner has been implicated in this case only based on the confession of the co-accused and he is ready and willing to abide by any condition that may be imposed by this Court and hence prayed to grant bail to the petitioner.

4. The learned Government Advocate (Criminal side) strongly objected to enlarge the petitioner on bail on the ground that there are 7 other previous cases pending against the petitioner.

5. From the submissions made by the learned Government Advocate, it appears that the petitioner has been incarcerated since 20.01.2026. Though the petitioner has been under judicial custody for the past past nearly 45 days, considering the fact that there are 7 previous cases, as rightly contended by the learned Government Advocate, if the petitioner is enlarged on bail, it would

cause fear psychosis among the public at large. Therefore, this Court is not inclined to enlarge the petitioner on bail.

6. Accordingly, this Criminal Original Petition is dismissed. 06-03-2026 MJS Note:
