Respondent (Suo motu added as the respondent in the place of Karana, Inspector of Police, Thiruvalam Police Station, Vellore District, as per the order of this Court made in Cont.P.No.867/2025, dated 21.3.2025) Contempt Petition filed under Section 11 of the Contempt of Courts Act, to punish the respondent under the Contempt of Courts Act, 1971 for his willful and wanton disobedience of the directions/orders, dated 27.07.2023 passed by this Court in Crl.MP.No.10829 of 2023 in Crl.OP.No.16830 of 2023. ORDER

This Contempt Petition was filed on the ground that the order passed by this Court in Crl.MP.No.10829 of 2023 in Crl.OP.No.16830 of 2023 dated 27.07.2023 was not complied with.

2.Pursuant to the earlier order passed by this Court on 01.04.2025, the matter was listed for hearing today and a better affidavit has been filed by the respondent/contemnor. The relevant portions are extracted hereunder: 6.It is submitted that inadvertently without the knowledge of the above orders dated 27.07.2023 by this Hon'ble Court, on 29.10.2024, the respondent filed final report before the learned Judicial Magistrate, Katpadi and the same was taken on file in C.C.No.120/2024 dated 08.11.2025. Now, on 24.03.2025, the present Inspector of Police, Thiruvalam Police Station, had sent a requisition letter to the learned Judicial Magistrate, Katpadi to defer the proceedings in C.C.No.120/2024 in view of the stay granted by this Hon'ble Court.

7.I respectfully submit that I once again tender unconditional apology for the act in the part of the respondent. I respectfully submit that i am having highest regards for his Honourable Court and the court directions. I always obey and comply with the directions of this Honourable Court.

3.The learned counsel for the petitioner submitted that since the final report has been filed, the petition filed for quashing the FIR was dismissed as infructuous by an order dated 05.03.2025.

4.In the considered view of this Court, even before the interim order was passed by this Court on 27.07.2023, the investigation had been comleted and the final report had been prepared and filed on 04.05.2023. The same was not brought to the notice of this Court when the stay was granted. 5.In the light of this development, it is left open to the petitioner to question the proceedings pending in C.C.No.120 of 2024, Judicial Magistrate, Katpadi. Except giving this liberty, no further orders can be passed in this contempt petition and accordingly, the same is closed.
