ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 03.03.2021 for the alleged offences punishable under Sections 328 of I.P.C and Section 24(i) of COTPA Act, 2003, in Crime No.713 of 2020, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner along with other person were in possession of banned tobacco products of 720 kgs worth about 4,00,000/- Hence, the complaint.
3. The learned counsel appearing for the petitioner would submit that the main accused is A1 and this petitioner is A3 and he was only present in the scene of occurrence, due to which he has been falsely implicated in this case. Hence he prays for grant of bail to the petitioner.
4.The learned Additional Public Prosecutor submits that the petitioner is a habitual offender and there are 8 previous cases pending against the petitioner. Hence she vehemently opposed for grant of anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
5.Taking note of the facts of the case and the submission advanced by the learned additional public prosecutor that the petitioner is a habitual offender and there are 8 previous cases pending against him, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
