ORDER

The petitioner, who was arrested and remanded to judicial custody on 27.01.2026 for the alleged offence under Section 123 BNS, 2023, Section 22 (a) of Cigarette and other Tobacco Products Acts 2003 and Section 59 of Food Safety and Standards Act 2006 in Crime No.61 of 2026 on the file of the respondent Police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused were found in illegal possession of 400kgs of banned tobacco products. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and has been in custody since 27.01.2026. He also submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and undertakes not to tamper with the witnesses. Hence, he prayed for grant of bail.

4.The learned Government Advocate (Criminal Side) would submit that the petitioner is having one previous case of similar nature of offences. He would further submit that if the petitioner is released on bail, he may abscond and tamper with witnesses and hence, he opposed the grant of bail.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6.Though the learned counsel for the petitioner ingenuously submits that the petitioner has been in long incarceration of 38 days, while considering the gravity of the offence, recovery of 400kgs of tobacco product that too poisonous and also considering the pendency of previous case against this petitioner, and by considering the objection raised by the learned Government Advocate (Criminal side), this Court is not inclined to enlarge the petitioner on bail.

7.Accordingly, this Criminal Original petition is dismissed. 05-03-2026 ep
