JUDGMENT

Appellant is the accused No.1 in S.C.No.43 of 2008 on the file of the learned Principal District and Sessions Judge and Special Judge, Coimbatore. By the Judgment dated 17.7.2009, the learned Principal District and Sessions Judge and Special Judge, Coimbatore, convicted the Appellant / Accused No.1 under Section 3(1)(x) of the SC and ST Act and sentenced him to undergo six months rigorous imprisonment and imposed a fine of Rs.1,000/-, in default, to undergo one month rigorous imprisonment and convicted him under Section 324 I.P.C. (2 counts) and sentenced him to undergo six months rigorous imprisonment each and imposed a fine of Rs.1,500/- each, in default, to undergo one month rigorous imprisonment. Aggrieved over the said conviction, the Appellant / Accused No.1 has preferred this appeal.

2. Today, when the appeal was taken up for hearing, it is represented that the Appellant / Accused No.1 had died. Death Certificate of the Appellant / Accused No.1 issued by the Coimbatore City Municipal Corporation has also been produced before this Court stating that the Appellant / Accused No.1 died on 8.8.2014.

3. Therefore, this appeal is dismissed as abated on the death of the Appellant / Accused No.1. Consequently, connected miscellaneous petition is closed.
