This application has been filed by the applicant/plaintiff seeking permission to receive the additional documents mentioned in the application.
2. It is averred in the application that the documents mentioned in the application are only true copy of the returns filed with the Income Tax Department and they are vital documents and the same were omitted to be filed in time.
3. Learned counsel for the respondents has no serious objection, however, he submits that the same may be received subject to relevancy and proof.
4. Considering the reasons given by the applicant/plaintiff and also the facts and circumstances of this case, this court is of the considered view that this application is to be allowed.
5. In fine, the application is allowed and the documents mentioned in the application are ordered to be received, subject to relevancy and proof.
