ORDER

The learned Government Advocate appearing for the respondent has filed the additional typed set of papers, which includes the Proceedings, 1/5

dated 13.06.2024 of the respondent. As seen from the same, the order which is the subject matter of this contempt petition has been complied with, as final orders have been passed pursuant to the order dated 05.01.2023 passed by this Court in W.P. No.172 of 2023.

The learned counsel for the petitioner would vehemently oppose the closure of this contempt petition, as according to him by total non application of mind, the respondent has once again passed a similar order, which was earlier quashed by this Court vide order dated 05.01.2023 passed in W.P. No.172 of 2023, which is the subject matter of this contempt petition.

However, the learned Government Advocate appearing for the respondent would submit that different reasons have been given by the respondent for rejecting the petitioner's representation and therefore, if at all the petitioner is aggrieved, she will have to challenge the Proceedings of the respondent, dated 13.06.2024, which was passed pursuant to the order, dated 05.01.2023 passed in W.P. No.172 of 2023, which is the subject matter of this contempt petition.

4. The scope of this contempt petition is limited. While examining the contempt petition, this Court will have to see only as to whether the order, which is the subject matter of the contempt petition, has been complied with or not. In the case on hand, the respondent has passed final orders pursuant to the directions issued by this Court. Since final orders have been passed necessarily, if the petitioner is aggrieved by the same, she will have to challenge the same in the manner known to her under law and she cannot question the same in this contempt petition, where the scope is limited. The respondent also do not admit as seen from the submissions made by the learned Government Advocate appearing for the respondent that the reasons given by the respondent for rejecting the petitioner's request were similar to the ones given under the earlier order passed by the respondent, which was quashed by this Court.

5. For the foregoing reasons, this contempt petition is closed as the order, which is the subject matter of this contempt petition has been obeyed by the respondent in letter and spirit. However, liberty is granted to the petitioner to challenge the Proceedings of the respondents dated, 3/5

30.01.2024, 08.04.2024 and 13.06.2024, if so aggrieved in the manner known to her under law.
