ORDER

This Writ Petition has been filed for the following reliefs:- "directing the respondents to pay a sum of Rs.42,565.80/- toward difference in Gratuity with 10 percent interest to the petitioner." 2.The case of the petitioner is that he had joined the services of the respondent Corporation as a Conductor on 27.01.1978 and rendered about 33 years of continuous service. During his service, he was promoted to the post of Traffic Inspector with effect from 28.02.2011 and his basic pay was revised accordingly. However, at the time of his retirement, the respondent had calculated and paid gratuity based only on the pre-revised basic pay and prerevised Dearness Allowance, and not on the revised basic pay and revised Dearness Allowance.

According to the petitioner, the gratuity payable to him ought to have been calculated based on the revised basic pay along with the revised Dearness Allowance. Since the respondent failed to do so, the petitioner had submitted a representation dated 06.12.2025 to the respondent seeking payment of the differential gratuity along with interest. However, to date, the said representation has not been considered. Hence, the present writ petition has been filed.

3. Heard the learned counsel on either side.

Considering the limited relief sought for by the petitioner, and taking note of the fact that the petitioner's representation dated 06.12.2025 has not been considered to date, the Writ Petition is allowed. The respondent is directed to consider and pass orders on the petitioner's representation dated 06.12.2025, on merits and in accordance with law, within a period of 3 weeks from the date of receipt of a copy of this order.
