ORDER : The Court Made the following order :- The petitioner, who apprehend arrest for the alleged offences under Sections 4(1)(aaa), 4(1-A) of the Tamil Nadu Prohibition Act, in Crime No.283 of 2022 on the file of the respondent police, seek anticipatory bail.

2. It is a case of illegal transport of Pondy I.D.Arrack into Tamil Nadu. 110 litres of I.D. Arrack was seized by the respondent police on 19.02.2022 from the statement of the rider who transport the arrack in the two wheeler vehicle belongs to this petitioner and on his instructions he was transported the I.D. Arrack.

3. Earlier, this petitioner moved anticipatory bail petition and produced the document alleged to be the delivery note for the sale of the two wheeler and pleaded that he is not the owner of the two wheeler. However, on perusing the delivery note, this Court https://hcservices.ecourts.gov.in/hcservices/

finds that it is not a document related to real transfer of name or concern to transfer the registration. It appears to be a document prepared as an after thought. Hence, anticipatory bail petition is dismissed and also recorded that two previous cases was against this petitioner with similar nature along with the confession statement of the co-accused disclosed that the petitioner has organised the transport of I.D.Arrack into State of Tamilnadu with the help of A1. Since, there is no change of circumstances, this Criminal Original Petition is dismissed.
