Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 1st respondent herein to consider the petitioner's representation dated 02.12.2017 for rectification of defects in the Revenue records with regard to erroneous classification of lands measuring about 61.70 acres comprised in Survey No.106 situated at Vatiripalli Village, Hosur Taluk, Krishnagiri District and issue patta to the petitioner.

Mr.S.N.Parthasarathy, learned Government Advocate takes notice for the respondents. By consent of both parties, the writ petition is taken up for final disposal at the admission stage itself.

2. The petitioner seeks for a mandamus directing the 1st respondent to consider his representation dated 02.12.2017,

wherein and whereby, he sought for rectification of defects in the Revenue records with regard to erroneous classification of lands measuring about 61.70 acres comprised in Survey No.106 situated at Vatiripalli Village, Hosur Taluk, Krishnagiri District and issue patta to the petitioner.

3. It is stated that the petitioner is in peaceful possession and enjoyment of the subject matter land. It is further stated that while updating of Registry cases (UDR), the lands measuring an extent of 61.70 acres in Survey No.106 were wrongly classified as "Machal Tharai". Hence, the petitioner made a representation dated 02.12.2017, seeking to rectify the mistake crept in the Revenue records. The grievance of the petitioner before this Court is that even though he made a representation on 02.12.2017, the respondents has not considered the same so far.

4. Heard both sides.

This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner, as it is for the first respondent to consider and decide the same on merits and in accordance with law. Accordingly, this Writ Petition is disposed of only with a direction to the first respondent to consider the representation dated 02.12.2017 and pass orders on the same on merits and in accordance with law, after hearing the petitioner and other interested parties, if any. Such exercise shall be done by the first respondent within a period of eight weeks from the date of receipt of a copy of this order. No costs.
