Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to (i) To condone the absence of reporting of the petitioner from May 2020, August 2020 and November 2020 before learned XI Additional Special Judge (CBI cases relating to Banks and Financial Institutions), Chennai in M.P.No.1 of 2014 in Crl.A.No.678 of 2013 order dated 08.1.2015.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.T.I.RAMANATHAN, Advocate for the petitioner, and of MR.K.SRINIVASAN, Special Public Prosecutor for CBI-cases, on behalf of the Respondents the court made the following order:- As per earlier order passed by this Court in M.P.No.1 of 2014 in Crl.A.No.678 of 2013, dated 08.01.2015, directing the petitioner/S.Natarajan to report before the learned XI Additional Special Judge (CBI Cases relating to Banks and Financial Institutions), Chennai, once in three months i.e. February, May, August and November, 2020, the petitioner has filed the present petition seeking to condone the absence of his reporting before the said Court during such months.

2. Heard both side.

3. The petitioner was convicted and sentenced for the offences u/s.120B r/w 420, 468, 471 r/w 468, 465 and 471 IPC and 13(1)(d) r/w 13(2) of Prevention of Corruption Act, 1988 by the trial Court in C.C.No.225 of 1997 on 30.08.2013.

4. Today, when the matter was taken up for hearing, the learned counsel for the petitioner submitted that as per earlier order passed by this Court in Crl.M.P.No.1 of 2014 in Crl.A.No.678 of 2013, dated 08.01.2015, although the petitioner has complied with the condition without fail in February, 2020, he was unable to comply with the said condition during the months of May, August and November, 2020 due to the COVID-19 pandemic, followed by lock-down announced by the Government.

5. Being satisfied with the reasons stated in the affidavit filed in support of this petition, this petition is allowed and the absence of reporting of the petitioner is condoned.

6. Considering the submissions made by the learned counsel for the petitioner, this Court is inclined to follow the earlier order passed by this Court on the petitioner. Accordingly, the petitioner is directed to report before the learned XI Additional Special Judge (CBI Cases relating to Banks and Financial Institutions), Chennai, once in three months i.e. from September, 2021, onwards, on the first working day of that month at 10.30 a.m. until further orders. -sd/- 19/08/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
