For the sake of convenience, the petitioner and respondents will be referred to as the complainant and the accused.

2. Heard Mr.R.Vivekananthan, learned counsel for the complainant and Mr.B.R.Shankaralingam, learned counsel for the accused.

3. The complainant initiated a prosecution in C.C.No.8685 of 2007 under Section 138 of the Negotiable Instruments Act, 1881, against the accused, before the Metropolitan Magistrate-III Court (Fast Track Court), Coimbatore. The learned Metropolitan Magistrate-III, by judgment and order dated 14.03.2018, convicted and sentenced the accused. Challenging the same, the accused preferred an appeal in C.A.No.110 of 2018 before the XVIII Additional Sessions Court, Coimbatore. 4. Aggrieved by the judgment and order of acquittal, the complainant is before this Court.

5. The complainant has raised substantial grounds in the memorandum of appeal which requires detailed consideration. Hence, leave granted.
