Mr.R.Govindasamy, learned Special Government Pleader takes notice for the respondents. By consent of the parties, the main writ petition itself is taken up for final disposal.
2. The petitioner seeks for a Mandamus directing the 2nd respondent to consider the petitioner's representations dated 10.07.2017 and 07.12.2017, wherein and whereby, he has sought for grant of patta in his name, whereas in the subject matter patta granted to him, some other persons names are also included.
3. It seems that the petitioner has given a representation only on 07.12.2017. Even though it is stated that another representation was given on 10.07.2017, there is no proof to https://hcservices.ecourts.gov.in/hcservices/
show that the same was received by the Tahsildar, namely, the second respondent. On the other hand, it is stated by the petitioner that it was given in person.
4. In any event, as the petitioner contends that in the subject matter patta, some other persons names were included, unless he specifically furnishes the details and make a fresh representation to the second respondent, the said official will not be in a position to consider the grievance of the petitioner. Therefore, liberty is granted to the petitioner to give a fresh representation by furnishing the material details including the name of the persons in whose name patta is standing as on date. If any such representation is received by the second respondent, the same shall be considered by the second respondent and orders shall be passed on merits and in accordance with law after issuing due notice to all the parties concerned. Writ Petition is disposed of accordingly. No costs. Sd/- Assistant Registrar(CS-) //True Copy// Sub Assistant Registrar vsi To
