ORDER
This petition has been filed seeking a direction to the 2nd respondent the Revenue Divisional officer, Udhagamandalam, to pass order on Na.Ka.A3/ 387/ 2025 dated 12.6.2025 pending on the file of the 2nd respondent herein, in so far as it relates to the private road situated in S.Nos.33/2, 33/6 and 33/7 Glenmorgan Estate, Glenmorgan Post, Udhagamandalam, Nilgiris District owned by the petitioner.
2. It is the case of the petitioner that the petitioner purchased Glenmorgan Estate by way of registered sale deed from the erstwhile owner. The respondents 3 to 11 trespassed into the internal road of Glenmorgan Estate situated at S.Nos.3/2, 33/6 and 33/7 Glenmorgan Estate, Glebmorgan Post, Udhagamandalam, Nilgiris District. The Revenue authorities issued notice to
the private respondents and the petitioner to the peace committee meeting and due to some unforeseen circumstances, they could not attend the meeting. Thereafter, the petitioner made a representation on 09.09.2025 to the District Collector in respect of temporary arrangements of permitting the movement of small trucks and the people for a period of three months on a license basis. The District Collector, directed the Revenue authorities to take necessary action in this regard. Till date, the Revenue authorities failed to pass final orders. Hence, the petitioner has come up before this Court.

The learned counsel for the petitioner submitted that this Court may direct the respondents to conclude and pass orders on the enquiry dated 12.06.2025 in respect of the private road situated in S.Nos.33/2, 33/6 and 33/7 Glenmorgan Estate, Glebmorgan Post, Udhagamandalam, Nilgiris District which is owned by the petitioner, within the stipulated time as fixed by this Court.
4. The learned Special Government Pleader appearing for the respondents submitted that the enquiry will be concluded and appropriate orders will be passed within the stipulated time as fixed by this Court.
5. Heard the learned counsel for both side and perused the materials
available on record. Since no adverse order is passed against the private respondents, notice to them is dispensed with.
6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the second respondent to conclude and pass orders on the enquiry proceedings dated 12.06.2025 within a period of four weeks from the date of receipt of a copy of this order.
7. With the above directions, the writ petition is disposed of. Consequently, connected miscellaneous petition is closed. No costs. 10-03-2026 Index: Yes/No Speaking/Non-speaking order RLI To
