By consent of both parties, this writ petition is taken up for final disposal.

2. This writ petition is filed challenging the notice issued by the respondent to appear in respect of the complaint given by the second respondent for cancellation of the document.

3. Heard both sides and perused the materials placed on record.

4. This Court is of the view that merely on the basis of some complaint, the document already registered cannot be cancelled. The registering authorities cannot go into the documents except the documents registered contrary to Sections 22-A or 22-B of the Act.

5. Such view of the matter, the impugned notice dated 04.03.2023 issued by the first respondent is set aside and accordingly, the writ petition stands allowed. No costs. Consequently, connected miscellaneous petition is closed. 16.04.2024 dhk Index :Yes/No Internet : Yes/No : Yes/No 2/4
