This application has been filed by the 3rd and 4th defendants to condone the delay in filng the written statement along with counter claim. In the affidavit filed in support of the judges summons, the third defendant had stated that the suit had been filed seeking for partition and for permanent injunction, and that there were talks of settlement, and mutual negotiations were going on pending the suit. It is also stated that the 3rd defendant was hopeful of an amicable settlement. Since that had not come to effect, necessity to file written statement had arisen and in the meanwhile, there has been a delay of 30 days.

2. Heard the learned counsel for the plaintiff also.
