This Criminal Original Petition has been filed to recall Non-Bailable Warrant issued against the petitioner on 12.12.2023 in PRC No.142 of 2011, after split up, now 1/4

pending in PRC No.151/2023 on the file of XXIII Metropolitan Magistrate Court, Saidapet, Chennai.

2.The petitioner is arrayed as accused in PRC No.151 of 2023, on the file of the learned XXIII Metropolitan Magistrate Court, Saidapet, Chennai, for the offences punishable under Sections 147, 148, 302, 506(ii), 34, 149, 120(b) of IPC.

3. The petitioner was absent during the trial in PRC No.151 of 2023, on the file of the learned XXIII Metropolitan Magistrate Court, Saidapet, Chennai. Therefore non bailable warrant came to be issued on 12.12.2023.

4. The learned counsel appearing for the petitioner undertakes that the petitioner shall appear before the Court below regularly on all future hearing dates without fail.

5. Considering the undertaking given by the petitioner, the petitioner is directed to appear before the learned XXIII Metropolitan Magistrate Court, Saidapet, Chennai, within a period of two weeks from today and file a petition to recall the NBW issued against him. The concerned Magistrate is directed to consider the same on merits and pass orders on the same day.
