J. Naval Kishore v. Vimala Bai
A.No.5517 of 2016 in C.S.No.509 of 1994 M.SUNDAR.J., This application has been taken out by the plaintiff in the main suit with a prayer to condone a delay of 23 days in filing an application to bring on record the legal heirs of the deceased 5th defendant.
2. Heard Mr.C.Jagadish, learned counsel for the applicant/plaintiff.
3. Mr.V.Shanmuganathan, learned counsel representing M/s.Vikram U.Jain who is present on behalf of the respondent submits that there is no serious opposition or objection to this application.
4. Perused the affidavit filed in support of the delay condonation prayer and heard both learned counsel at the Bar. Ends of justice would be subserved if this application is allowed. The prayer in the application is innocuous in nature and the delay is only 23 days.
5. Application is allowed.
