ORDER

This writ petition has been filed to direct the second respondent to provide an alternate accommodation for dwelling to the petitioner by allotting a house under any scheme of the Central or State Governments or to allot a free housing site patta in favour the petitioner.

2. The petitioner has been vacated from the existing premises. According to him, he has been evicted illegally. The petitioner now seeks for an alternate accommodation in place of the premises, where he was earlier living and from where he has been evicted. The petitioner had earlier given representations to the respondents to provide alternate accommodation as prayed for in this writ petition. Since the said representations have not been considered, the petitioner has filed this writ petition.

3. Till date, counter has not been filed by the respondents in this writ petition. However, this Court is of the considered view that no prejudice would be caused to the respondents if the petitioner's representations seeking for alternate accommodation as prayed for in this writ petition are considered on merits and in accordance with law within a time frame to be fixed by this Court.

4. This Court is not expressing any opinion on the merits of the petitioner's representations. Since the representations given by the petitioner prior to the filing of this writ petition are old ones, the petitioner is directed to give a fresh representation.

5. For the foregoing reasons, this Court directs the petitioner to submit a fresh representation to the second respondent, seeking for providing an alternate accommodation for dwelling purpose to the petitioner either by allotting a house under any scheme of the Central or State Governments or by allotting a free housing site patta to the petitioner within a period of two weeks from the date of receipt of a copy of this order. On receipt of the said representation, within the stipulated time from the petitioner, the second respondent shall pass final orders on merits and in accordance with law on the said representation within a period of twelve weeks thereafter.
