IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED : 15.06.2016
CORAM:
THE HON'BLE MR.JUSTICE R.SUBBIAH Crl.A.No.625 of 2009 T.Balaji ... Appellant Vs., R.Subramaniam ... Respondent Prayer: Criminal Appeal has been filed under Section 378 (4) of Cr.P.C., against the order passed by the learned Judicial Magistrate No.IV, Vellore, Vellore District in C.C.No.181/2006, dated 20.08.2009.
For Petitioner : Mr.E.Kannadasan For Respondent : Mr.R.Sivakumar
ORDER
This is an appeal against the order of acquittal dated 20.08.2009 passed under Section 256 of Cr.P.C. It is seen that the cheque amount in this case is only a sum of Rs.75,000/-. This appeal was filed in the year 2009. Now, almost eight years have lapsed. Further, the appellant has not shown reasonable cause for his non-appearance before the Court below on 20.08.2009, on which date the impugned order of acquittal was passed. Hence, at this distant point of time, I am not inclined to entertain this appeal. Accordingly, the criminal appeal is dismissed.
