Mr. Vinoth Kumar Government Advocate (Crl Side) Order The petitioner, who was arrested and remanded to judicial custody on 22.12.2021 for the alleged offence under Section 8(c) r/w. 22(c), 28 and 29 of the NDPS Act in C.C.No.123 of 2022 on the file of the 1st Additional Special Judge For EC and NDPS Cases, Chennai in R.R.No.50 of 2021 on the file of the

respondent, seeks bail.

2. The case of the prosecution is that the petitioner was found in possession of 1 kg of Methamphetamine. Hence, this case.

3. The learned counsel for the petitioner submitted that the petitioner is 71 years old and his medical condition is not appreciable. He further submitted that taking into consideration the medical condition of the petitioner, this Court vide order dated 02.11.2023 had directed to dispose of the case within a period of eight weeks. Subsequently, the progress of the order was not mentioned in the order dated 04.04.2024 and even now the trial had not been completed and unless the petitioner is enlarged on bail, his health condition would deteriorate. Hence, he prays for grant of bail to the Petitioner.

4. Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and submitted that the trial is at advanced stage and it has been posted for argument on 25.03.2026. Hence, he opposed the grant of bail to the Petitioner.

5. I have given my anxious consideration to either side submissions and perused the materials available on record.

6. From the submissions made by the learned counsel on either side and in such view of the advanced stage of the trial, this Court is of a firm view that in commercial quantity cases, it is not desirable to enlarge the petitioner on bail. Hence, this Criminal Original Petition is dismissed. However, this Court would like to direct the Prison Authorities to give proper medical treatment to the petitioner as per the medical advice given by the Prison Doctor. 24-03-2026 SHL To:
