ORDER
This Contempt Petition has been filed to punish the respondents for willfully disobedience of the order dated 24.06.2015 passed by this Court in Crl.OP.No.15402 of 2015.
2. Today, Mr.Duraipandiyan, Inspector of Police, Thirupattur Police Station, Thirupattur, Vellore District is present.
3. On 07.11.2016, this Court passed the following order:- "Mr.S.K.Duraipandian, the Inspector of Police, Villupuram formerly, the Inspector of Police, Tirupathur Town Police is present today.
The learned Additional Public Prosecutor submitted that there are two police stations namely, Town and Taluk Police Stations in Tirupathur. The alleged property is said to be within the jurisdiction of the Tirupathur Taluk Police Station.
It is submitted that the petitioner has not stated the correct particulars in regard to the property in dispute, name details and his address and police station properly in both the Crl.OP and the Contempt Petition.
It appears that name details and address of the petitioner are also different in Crl.OP and Contempt Petition.
Since there is no representation for the petitioner, the office is directed to list the case under the caption "for dismissal" on 09.11.2016.
4. When the matter was called on 07.11.2016, there was no representation for the petitioner. Hence, the matter was directed to be posted today under the caption "for dismissal".
5. Learned counsel appearing for the petitioner submitted that Mani is a male and not a female and he was wrongly shown in the cause title as Mani, wife of Madhu.
6. That apart, this Court finds that even in Crl.OP.No.15402 of 2015, which is the subject matter of the contempt petition, the Station House Officer was not arrayed as a party. Therefore, there there are no prima facie materials for issuance of statutory notice against alleged contemnor.
Hence, the petition is dismissed.
