01.10.2011 with all consequential attendant benefits within the time frame to be fixed by this Court and to pass such further or other orders as this Court may deem fit and proper in the facts and circumstances of the case. O R D E R

The writ petition has been filed challenging the order of the promotion of the third respondent. The ground on which the challenge is made, is that the seniority list has not been followed and the third respondent has been overlooked only on the ground which the promotion code approval was made, which is contrary to the regulations to join duty.

2. When the matter is taken up, it is brought to the notice of this Court that the third respondent had superannuated and the petitioner has also been promoted.
