ORDER
This writ petition has been filed for the issue of a writ of mandamus directing the 2nd respondent to entertain and register the sale deed presented for registration with respect to the subject property.
2.When the matter was taken up for hearing on 04.04.2025, this Court passed the following order:
Mr.U.Baranidharan, learned Special Government Pleader takes notice on behalf of the respondents.
2.The main grievance that was expressed by the learned counsel for the petitioner is that the petitioner earlier had presented the Sale Deed dated 07.09.2017 for registration before the 2 nd respondent. The same was refused to be registered by the 2 nd respondent through a refusal Check Slip dated 04.01.2021. The said refusal Check Slip was put to challenge before this Court in W.P.No.259 of 2024. This writ petition came to be dismissed by an order dated 09.01.2024 by giving liberty to the petitioner to workout his remedy in the manner known to law. 3.Pursuant to the above order, the petitioner had approached the competent authority and sought for No Objection Certificate and the competent authority through communication dated 03.09.2024 had informed the 2 nd respondent that the subject property does not form part of the acquisition proceedings. The grievance of the petitioner is that in spite of such a communication made to the 2 nd respondent, the document 2 / 4
is not being entertained and registered. It is under these circumstances, the present writ petition came to be filed before this Court.
4.The learned Special Government Pleader appearing on behalf of the respondents seeks for some time to take instructions in this case.
5.Post this case at the end of the motion list on 08.04.2025. 3.Heard Mr.G.M.Ananthakumar, learned counsel for the petitioner, Mr.U.Baranidharan, learned Special Government Pleader for respondents. 4.In the considered view of this Court, the competent authority through communication dated 03.09.2024, has already informed to the 2nd respondent that the subject property does not form part of the acquisition proceedings. In view of the same, there can be no objection for the 2nd respondent to entertain the document and register the same, if it is otherwise in order. 5.This writ petition is disposed of in the above terms.
