KRISHNAN RAMASAMY J., This application is filed by the applicant / plaintiff to grant leave to the applicant to sue the 3rd respondent / 3rd defendant in respect of Item No.1 of the Schedule of property.

2. The learned counsel for the applicant submits that the substantial cause of action arose within the jurisdiction of this Court and though the property of the 3rd defendant is situated outside the jurisdiction of this Court, the 3rd respondent resides within the jurisdiction of this Court, hence seeks to allow the present application.

3. The learned counsel for the respondents fairly submitted that all the respondents are residing within the jurisdiction of this Court and only the property of the 3rd defendant, Item No.1 is situated outside the jurisdiction, thereby contended no objection in allowing the present application.

4. Considering the submission of the learned counsel for the applicant and the 'no objection' expressed by the learned counsel for the respondents and being satisfied with the averments made in the affidavit filed in support of this application, this application is allowed. 10.06.2022 ssd
