Criminal miscellaneous petition filed under Section 528 of BNSS, seeking to relax the condition imposed in para no.5 of the order dated 15.11.2024 made in Crl.MP.No.15456 of 2024 in Crl.A.No.1352 of 2024 till the disposal of the above said criminal appeal. ORDER

Vide order dated 15.11.2024 made in Crl.MP.No.15456 of 2024 in Crl.A.No.1352 of 2024, this Court had suspended the substantive sentence of imprisonment imposed on the petitioner and enlarged him on 1/4

bail on certain conditions and one among such conditions is that the petitioner shall appear before the trial court on the 1st working day of every month at 10.30 am. until further orders. This criminal miscellaneous petition has been filed by the petitioner seeking relaxation of the aforesaid condition, on account of his serious indisposition.

2. Learned Special Public Prosecutor appearing for the respondent submitted that the petitioner has been complying with the condition imposed by this Court without any default.

3. In view of the above, this Court is inclined to modify the condition imposed by this Court in respect of the appearance of the petitioner in the following manner.

Accordingly, the condition insofar as the petitioner's appearance as imposed by this Court at para no.5 of the order dated 15.11.2024 made in Crl.MP.No.15456 of 2024 in Crl.A.No.1352 of 2024 alone stands modified to the effect that the petitioner shall appear before the trial Court once in every four months on the first working day of the particular month, commencing from April 2026. All other conditions imposed in the order dated 15.11.2024 remain unaltered.

5. This criminal miscellaneous petition stands ordered accordingly.
