Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 1st and 2nd respondents to provide adequate police protection to the petitioner and Revenue Department Field Surveyor officials, for scaling and putting up boundary stones and fencing in the landed extent in S.No.576/1A to the extent of 55 cents in Patta No.3946 and S.No.576/1F to the extent of 63 cents in Old Patta No.1606/New Patta No.2854 at Anchetty East Village, Anchetty Taluk, Krishnagiri District, in as per the representation dated 31.12.2023 made by the petitioner.

ORDER

This writ petition has been filed in the nature of Mandamus seeking a direction to the 1st and the 2nd respondents to provide adequate police protection to the petitioner while the Revenue officials namely, Field Surveyor officials, put up boundary stones and fence in the land in S.No.576/1A measuring 55 cents in Patta No.3946 and in S.No.576/1F

measuring 63 cents in Old Patta No.1606 / New Patta no.2854 both at Anchetty East Village, Anchetty Taluk, Krishnagiri District. The petitioner had given a representation on 31.12.2023 in this regard. 2.It is also stated that the petitioner had also lodged a complaint raising grievance against the 4th, 5th and 6th respondents herein that they are preventing the revenue officials from putting up the boundary stones and fencing the aforementioned land. This is not the first litigation between the petitioner and the 4th, 5th and 6th respondents but is the culmination of earlier proceedings before the revenue authorities and also before this Court. 3.Let met not enter into a detailed discussion about the facts, since this Court will have to be extremely careful in expressing any opinion about either the title or possession of the parties.

Let me therefore rest by just stating that on the basis of the complaint lodged by the petitioner, Current Paper in C.No.80/SDOE/SPGDP/2024 is pending on the file of the 2nd respondent. It would only appropriate that directions are given to the 2nd respondent to take a decision with respect to the said enquiry, which is now pending in the aforementioned Current Paper.

opportunity should be granted to all concerned, including the petitioner and the 4th, 5th and 6th respondents and to anybody else who are directly interested in the aforementioned lands to participate in the enquiry. 4.It is contended on behalf of the 1st and 2nd respondents that some reasonable time may be granted for concluding enquiry. Accordingly, four weeks time is granted for concluding the enquiry. 5.Liberty is also granted not only to the petitioner, but also to the 4th, 5th and 6th respondents, to take recourse to appropriate procedure of law, in case either of them have any grievance over the findings reached by the 2nd respondent on conclusion of the enquiry or for any other directions, if required.
