O R D E R
The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondents 1 to 3 to provide employment to the petitioner's son namely, M.T.Manigandan in Group-II Tamil Nadu Government Service in accordance with
G.O.Ms.No.188, Personnel and Administrative Reforms (Per.P) Department, dated 28.12.1976.
2.The case of the petitioner is that the petitioner's land to an extent of one Acre in S.No.95/1A in Sayanavaram Village was acquired by the Tamil Nadu Government for providing free house site patta for Adi-Dravidar during the year 1986. The petitioner was wholly dependent on the agricultural income derived from cultivation of the said property. The Government issued G.O.Ms.No.188, Personnel and Administrative Reforms (Per.P) Department, dated 28.12.1976, specifying the category of persons eligible to get priority for provision of employment assistance.
3.It is the further case of the petitioner that since his lands were acquired and since he did not have any other source of income, he made a representation to the fourth respondent on 03.07.2012 seeking to give priority to his son in the the Tamil Nadu Government Group II Service and the said representation was also acknowledged by the fourth respondent. The fourth respondent also sent a letter dated 29.10.2012 to the third respondent recommending that the petitioner's son may be given priority in the appointment to the Tamil Nadu Government Group II Service. However, no action was taken by the respondents 1 to 3. Hence, this writ petition.
4.Though the petitioner has sought for a larger relief, the learned counsel appearing for the petitioner would now submit that it would suffice, if this Court permits the petitioner to make a fresh representation to the respondents seeking to provide employment to the petitioner's son, in Group-II Tamil Nadu Government Service, in accordance with G.O.Ms.No.188, Personnel and Administrative Reforms (Per.P) Department, dated 28.12.1976. He further prays that this Court may issue direction to the respondents to consider the representation to be made by the petitioner.
5.The petitioner's land to an extent of one Acre in S.No.95/1A in Sayanavaram Village was acquired by the Tamil Nadu Government for providing free house site patta for Adi-Dravidar during the year 1986. The petitioner was wholly dependent on the agricultural income derived from cultivation of the said property.
6.Considering the above facts and the limited request now made by the learned counsel appearing for the petitioner, this Court permits the petitioner to make a fresh representation to the respondents seeking to provide employment to his son, in Group-II Tamil Nadu Government Service, in accordance with G.O.Ms.No.188, Personnel and Administrative Reforms (Per.P)
Department, dated 28.12.1976. If any such representation is received, the respondents shall consider the said representation and shall pass appropriate orders on the same, as expeditiously as possible.
7.With the above direction, this writ petition is disposed of. No costs.
