ORDER
The petitioner, who is the father of the sixth respondent, has filed the above writ petition to issue a Writ of Mandamus, directing the respondents 1 to 5 to consider his representations dated 20.6.2014 and 30.4.2015, pursuant to the proceedings of the 2nd respondent dated 19.03.2015 and thereby direct the respondents 1 to 5 to take suitable action under Section 21 of the Maintenance and Welfare of Parents and Senior Citizen Rules, 2009.
2. It is the case of the petitioner that the sixth respondent, after getting transfer of the property from him, abandoned and refused to take care and provide basic amenities and medical treatment. In these circumstances, the petitioner initiated legal proceedings under Rule 20 of the Tamil Nadu Maintenance and Welfare of Parents and Senior Citizen Rules 2009 and lodged a complaint on 20.6.2014 and on 18.12.2014 to the first respondent and his higher officials. On 20.6.2014 and during January 2015, the petitioner
gave representations to the respondents 1 to 5 and the representations were taken into consideration by the second respondent and notice was issued to the 6th respondent to appear for enquiry on 14.7.2014. However, the second respondent passed an order on 19.3.2015 stating that the relief sought for by the petitioner will not come under Rule 20 of the Tamil Nadu Maintenance and Welfare of Parents and Senior Citizen Rules, 2009. Thereafter, on 30.4.2015, the petitioner sent a reminder to the respondents. However, the respondents have not taken any action on the said representation.
3. Since the matter is pending before the respondents 1 to 5 for a long time, I am of the considered view that the District Collector, the first respondent herein, to consider and pass orders on the representations, as expeditiously as possible.
4. Accordingly, I direct the first respondent-District Collector to consider the petitioner's representations dated 20.6.2014 and 30.4.2015, pursuant to the proceedings of the second respondent dated 19.3.2015 and pass orders, on merits and in accordance with law, within a period of three weeks from the date of receipt of a copy of this order.
With this observation, the writ petition is disposed of.
