PRAYER The Writ Petition is filed under Article 226 of the Constitution of India for the issuance of a Writ of Mandamus to direct the respondents 1 to 3 to take appropriate action against the 4 th respondent based on petitioner representation dated 07.10.2024 within a time frame.

ORDER

(Order of the Court was made by J.NISHA BANU J.) The present Writ Petition is filed for the issuance of a Writ of Mandamus to direct respondent Nos.1 to 3 to consider the petitioner's representation dated 07.10.2024 within a time frame that may be fixed by this Court.

2. The learned counsel for the petitioner submits that the petitioner has made a representation dated 07.10.2024 before respondent Nos.1 to 3 to take appropriate action against the respondent No.4, who put up unauthorized construction and caused public nuisance to the nearby residents and he has also issued a Legal Notice dated 28.01.2025 to the respondents highlighting all the issues. But, the official respondents did not take any action on the petitioner's complaint. Hence, the petitioner is constrained to move the present Writ Petition.

3. Heard the learned counsel appearing for the petitioner and Mr.D.B.R.Prabhu, learned Standing Counsel appearing for respondent Nos.1 to 3 and perused the materials placed before this Court.

4. Considering the facts and circumstances of the case and considering the submissions made by the learned counsel appearing on either side, we direct respondent Nos.1 to 3 to consider the petitioner's representation dated 07.10.2024 and pass appropriate orders, on merits and in accordance with law, after issuing notice to the petitioner as well as the 4 th respondent and also affording them an opportunity of personal hearing. Such exercise shall be done by the official respondents, within a period of eight (8) weeks from the date of receipt of a copy of this order.

5. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
