2022-04-28Honourable Mr Justice M.Dhandapani3 pages

WMP.No.8719 of 2022 in W.P.No.4145 of 2019 M.DHANDAPANI, J.

The matter is listed today i.e.28.04.2022 under the caption "for being mentioned", at the instance of the learned counsel for the petitioner.

2. The learned counsel for the petitioner submitted that this Court, by an order dated 02.12.2021, disposed of the writ Petition and there is an typographical error committed in the 3rd paragraph as ''first respondent Bank'' instead of ''the first respondent''. The first respondent is not a Bank. Likewise, in the 5th para of the order portion, it is mentioned as Criminal Original Petition and it has to be typed as ''Writ Petition''. Therefore, the learned counsel prays to make necessary corrections and to issue fresh order copy.

3. In view of the above submission made by the learned counsel for the petitioner, this Court is inclined to modify the same in the order dated 02.12.2021 as follows:

''3. Though very many grounds have been raised, learned counsel for the petitioner submits that it would suffice if this Court issues direction to the first respondent to consider the petitioner's representation dated 07.09.2018 and pass orders on the same within a particular time frame fixed by this Court.

4. ..........................

5. In view of the aforesaid submissions, this Court, without going into the merits of the case, directs the first respondent to consider the petitioner's representation dated 07.09.2018 along with relevant documents and pass appropriate orders within a period of twenty four weeks from the date of receipt of a copy of this order. Accordingly, this Writ Petition is disposed of with the aforesaid directions. No costs.''

4. Except the above modification, remaining portion of the order dated 02.12.2021 shall stand unaltered.

28.04.2022 rli Note: Registry is directed to issue a fresh order copy after making necessary corrections.

M.DHANDAPANI, J.
