Crl.M.P.No.5107 of 2022 Crl.M.P.No.5107 of 2022 in Crl.O.P.No.24986 of 2021 A.D.JAGADISH CHANDIRA.J., This petition has been filed to relax the condition imposed by this Court in Crl.O.P.No.24986 of 2021 dated 22.12.2021.

2.Learned counsel for the petitioner would submit that the petitioner had filed Crl.O.P.No.24986 of 2021 seeking to recall the Non-Bailable Warrant dated 20.11.2015 issued by the learned Chief Judicial Magistrate, Salem in C.C.No.121 of 2005 and this Court by an order dated 22.12.2021, had recalled the NonBailable Warrant issued against the petitioner, with condition the petitioner shall appear before the trial Court and execute a bond for Rs.10,000/- with two sureties for like sum and appear before the trial Court on 1st and 3rd Monday of every month until further orders.

3.Learned Counsel for the petitioner would further submit that pursuant to the order dated 22.12.2021, the conditiions were complied with and the petitioner surendered before the Court and executed a bond for Rs.10,000/- with two sureties and the petitioner is appearing before the Trial Court on every 1st and 3rd Monday from 03.03.2022 without any further default. Crl.M.P.No.5107 of 2022 A.D.JAGADISH CHANDIRA.J., undertakes to appear before the trial Court regularly as and when required by the learned Magistrate and also submit that the petitioner shall be duly represented by a Counsel before the Trial Court on all hearing dates. 4.Learned Additional Public Prosecutor would submit that the petitioner is complying with the condition imposed by this Court without any deviation. 5.Considering the facts and circumstances of the case and also considering the submission made by the learned Additional Public Prosecutor that the petitioner is complying with the condition without any deviation, hence the condition imposed on the petitioner in Crl.O.P.No.24986 of 2021 to report before the trial Court, is totally relaxed. Hence, this Criminal Miscellaneous Petition is ordered.
