ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 465 and 467 of IPC in Crime No.19 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant had purchased the property from one Mohammed Saleem and subsequently, the petitioner herein had occupied the premises by creating a fake tenancy agreement. By forging the defacto complainant's signature, the petitioner had entered into a lease agreement with one Mrs.Preetha, impersonating him as owner. Hence, the defacto complainant had lodged a complaint before the respondent police against the petitioner.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case and prayed for grant of anticipatory bail. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Additional Public Prosecutor submitted that the investigation is still pending. Therefore, he opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the allegations and also the fact that the case is in the initial stage of the investigation and that the custodial interrogation of the petitioner is essential, this Court is not inclined to grant anticipatory bail to the petitioners.
