Prayer in W.P.No.6537 of 2013 : Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, calling for the records relating to the proceedings of the 1st Respondent in CME/A3/2464/03/MEE dated 04.09.2012 and quash the same and consequently assign proper place to petitioner in the seniority list vide reference No.CME/A3/2464/03/MEE dated 20.05.2009 and to give notional promotion to him by forthwith giving promotion to the post of Executive Engineer along with other monetary benefits to him. Prayer in W.P.No.6538 of 2013 :- Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, calling for the records of the first respondent relating to the seniority list vide reference No.CME/A1/25/12/MEE dated 25.01.2013 and quash the same and direct the 1st respondent to prepare a fresh panel of names including petitioner for the purpose of promotion to the post of Superintending Engineer (Mechanical).

COMMON ORDER Today, when these matters were taken up for consideration, the learned counsel for the petitioner, on instructions, submitted that subsequent to the filing of these writ petitions, the petitioner as well as the third respondent retired from service on attaining the age of superannuation and hence, nothing survives for adjudication.

2.In view of the above submission made by the learned counsel for the petitioner, these writ petitions are dismissed as having become infructuous. No costs. Consequently, connected miscellaneous petitions are closed.
